Welcome to Nikkimomo, LLC (“Nikkimomo,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, online store, SMS and email communications, and all related services offered by Nikkimomo, including our café offerings, pickup and dine-in experiences, and special events (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.


1. Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent that you are legally able to enter into this agreement.


2. Orders and Payments

  • All orders placed through our website or at our café are subject to acceptance and availability.

  • Prices are displayed in U.S. dollars and may change without notice.

  • Payment is due at the time of order through approved methods (credit/debit card, Shopify Payments, or other payment processors we support).

  • We reserve the right to cancel or refuse any order in cases of suspected fraud, errors, or availability issues.


3. Pickup, Dine-In, and Events

  • Pickup times are offered during designated service hours. Customers are responsible for selecting an available time slot.

  • Dine-in seating and special events (such as wine pairings or brunch) may require reservations and are subject to availability.

  • Event tickets or reservations are non-refundable unless otherwise stated.


4. SMS and Email Communications

By providing your phone number or email, you consent to receive communications from us, including:

  • Order confirmations, receipts, and pickup scheduling links

  • Marketing promotions, event invitations, and newsletters

SMS Program Terms:

  • Message frequency varies.

  • Standard message and data rates may apply.

  • Reply STOP to unsubscribe or HELP for help.

  • Participation in promotional SMS/email campaigns is not required for purchases.

  • We manage consent through HubSpot forms and comply with A2P 10DLC regulations.

5. Refunds and Cancellations

  • Food orders are prepared fresh and may not be refundable once fulfilled.

  • If you encounter an issue with your order, please contact us within 24 hours at rene@nikkimomo.com.

  • Refunds for prepaid events are subject to the specific event policy stated at the time of booking.


6. Intellectual Property

All content on our website and Services—including text, images, logos, menus, recipes, and branding (such as “View Park Café by NM” and MoMo’s Lemontime Lemonade)—is the property of Nikkimomo, LLC or its licensors. You may not copy, reproduce, or distribute our content without written permission.


7. Prohibited Uses

You may not use the Services to:

  • Engage in fraudulent or unlawful activity.

  • Resell or misuse tickets, reservations, or promotions.

  • Disrupt or harm our website, ordering system, or communications.


8. Limitation of Liability

To the fullest extent permitted by law, Nikkimomo, LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to delays, order errors, or communication issues.

You agree to indemnify and hold harmless Nikkimomo, LLC, its owners, employees, and partners against any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.


10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California.
